What Is a Court Bond in US Law?

The justice system in the United States can seem intimidating to the uninitiated. To some, the prospect of going on trial for a crime is nerve-wracking.

While the overall crime rate has been on the decline recently, the courts are more populated than ever with high-profile cases. Many celebrities, CEOs, and notable figures face charges of white-collar crimes, such as fraud and embezzlement. Those who find themselves accused of a crime should know that they aren’t alone.

What Is a Court Bond?

A court bond, also known as a judicial bond or a court surety bond, in US law is a financial guarantee that an individual or business will comply with the terms of a court order. It is usually required in civil proceedings where a plaintiff seeks a monetary award from a defendant in order to ensure that the defendant is able to satisfy that order.

Courts may also require a bond as a guarantee that any appeal of the original order will be handled in good faith. Court bonds can be posted in the form of cash or property. The use of a surety bond provided by an independent insurance company is also accepted.

The amount of the bond is typically set by a judge. It is commensurate with the amount of the award or the risks associated with the proceeding.

Common Types of Court Bond

A variety of types of bonds exist and are used by courts across the US. Each of them serves a specific purpose. Here are some of the most common.

Probate Bond

Probate bonds are court bonds that are obligated by the executor or administrator of a decedent’s estate. This bond is designed to protect the estate against any potential mismanagement by the executor or administrator, and also any other parties involved in the probate process. This bond guarantees that all debts and legal claims that are due to the estate are paid.

Bail Bond
