Acceptance of Terms Through Use

By using California Business Journal’s website, www.calbizjournal.com (the “Site”), you agree to be bound by all terms, conditions, and notices contained or referenced herein (the “Terms of Use”). We may change the Terms of Use at any time by posting revisions to the Site, and your continued use of the Site indicates your agreement to the revised terms. Permitted Use

California Business Journal may also, without notice or liability, impose limits on certain features and services or restrict your access to all or portions of the Site. You shall have no rights to the proprietary software and related documentation, if any, provided to you in order to access the Site. Except as provided in these Terms of Use, you shall have no right to directly or indirectly, own, use, loan, sell, rent, lease, license, sublicense, assign, copy, translate, modify, adapt, improve, or create any new or derivative works from, or display, distribute, perform, or in any way exploit the Site or any of its contents (including software) in whole or in part.

Violation of the Terms of Use

You understand and agree that in California Business Journal’s sole discretion, and without prior notice, California Business Journal may terminate your access to the Site or exercise any other remedy available and remove any unauthorized user information, if California Business Journal believes the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of California Business Journal or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to California Business Journal for violations of these Terms of Use, and you consent to injunctive or other equitable relief for such violations. California Business Journal may release user information about you if required by law or subpoena.

Copyright Policy

We may terminate the privileges of any user who uses the Site to unlawfully transmit copyrighted material without a license, express consent, valid defense, or fair use exemption to do so. If you submit information or content to the Site, you warrant that the information or content does not infringe the copyrights or other rights of third parties.

Representations By You

Blogs

The Blog Page of this website allows users to provide feedback to writers and editors at California Business Journal and provides a forum for real-time interaction between users of this website. Responsibility for what is posted on the Blog Page lies solely with each user—you alone are responsible and shall be held accountable for the material you post. California Business Journal controls the messages, information, or materials that you or others may submit to and through the Blog Page. It is a condition of your use of the Blog Page that you do not:

1. Use the Blog Page to post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law.

License Granted by You

By providing content or information to us, including by submitting or uploading content or materials for use on the Site, you represent and warrant that you or the owner of all rights to such content or materials has expressly granted us an irrevocable worldwide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. International Use

Choice of Law

You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of the Site shall be filed only in the state or federal courts located in the State of Indiana, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

Integration and Severability

This Terms of Use constitutes the entire agreement between California Business Journal and you with respect to the Site and supersedes all prior or contemporaneous communications and proposals between us with respect to the Site. If any provision of this Terms of Use agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect.

Refund Policy

No refunds are provided once an article is submitted and CBJ proceeds to edit and publish it.

No refunds are provided when an article and price are agreed upon by both parties, assigned to a CBJ correspondent who then proceeds with their research on the subject of the article and their business, formulating questions for the interview, conducting the interview and proceeding to write the first draft of the story.

For non-CBJ-staff-written “general” articles, once a buyer agrees to an article or link insert, they’re asked to process our PayPal invoice, at which point CBJ will edit and publish the article/link. No refunds for any reason other than a CBJ editorial error.

Any changes to an article or link must be brought to CBJ’s attention 48 hours ahead of the proposed publishing date.

CBJ Policy on Right to Edit Articles

CBJ reserves the right to edit any article to enhance it and present it more professionally to meet editorial standards. CBJ reserves the right to include up to two links to related CBJ staff-written articles that direct back to the CBJ website. CBJ articles do not include logos.

Timeframe on publishing articles and link inserts upon submission and/or approval: 24 hours

Section titles in the Term of Use are for convenience and do not define, limit, or extend any provision of the Terms of Use.
