Staying Aware: Navigating Local Dog Ownership Ordinances

The state of Illinois enacted dog ownership ordinances to protect the public from dog attacks. These laws work in conjunction with Illonois’s Animal Control Act, which encourages strict control over animals by imposing liability on owners. Navigating local dog ownership ordinances can often be challenging as the laws can get complicated. In this article, we try to simplify some of the laws so dog owners can understand their responsibility to the community and victims of such incidents can understand their rights.

Dog Bite Liability – What Makes Owners Liable for Injuries?

A dog owner can be held liable to fines and jail time as a result of a dog bite. Consequences of a dog bite or attack can include fines between $1000 and $10,000 and jail time of up to six months. The dog bite ordinance covers various aspects of dog ownership. This includes leash laws, waste management, and noise complaints.

Local Ordinances Surrounding Dog Ownership in Chicago, IL

According to chapters 7-12 of Chicago’s municipal code, the liability of a dog bite or attack lies with the owner of the dog. It is their responsibility to control their pet at all times. According to Illinois’ dog ownership ordinances, there is no room for any defense based on a lack of knowledge or lack of intent. This strict liability standard means that dog owners must be vigilant in protecting others from any type of harm their dog may cause.

Regarding laws for noise complaints, it is natural for dogs to make some noise. However, dog owners are encouraged to train their dogs to minimize barking. This is especially true for quiet hours. The leash laws vary by location. However, most leash laws require dog owners to have their dogs on a leash whenever they are in public.

Difference Between Negligence and Strict Liability

Negligence and strict liability are two distinct legal concepts used in personal injury cases such as dog bite incidents. In the negligence legal doctrine, the plaintiff must prove that the defendant had a duty of care to the plaintiff and this duty was breached as a result of the defendant’s negligence. In addition, the plaintiff has to prove that the negligence directly resulted in their injuries.

Strict liability is a different legal concept. In such cases, the plaintiff does not have to prove negligence or fault. The liability of the incident is determined based on the condition or act that caused the harm. The strict liability doctrine is applied to incidents of dog attacks or dog bites. However, a claim for negligence can also be filed for such incidents.

What to Do If You’re Injured By a Dog Bite in Illinois

For victims of dog bites, your first priority should be to seek medical attention. Injuries caused by dog bites can be severe. Even if you don’t feel the injuries require a visit to an emergency center, you should not take any chances. A dog bite can get worse over time if it gets infected.

Another important step is to gather evidence to help you with your personal injury claim. Evidence can include photos of the dog, your injuries, and the accident site. You should also report the incident so police can arrive and make an incident report.

Consult with a dog bite lawyer to seek guidance on legal steps to recover compensation for your injuries and prevent the dog from causing harm to others. If you have been a victim of a dog bite or attack, you have the right to seek compensation for your suffering. This includes your financial losses and the anger, frustration, and pain the incident caused you. In some cases, it’s not just the victim who suffers the consequences—their entire family can suffer from stress in the aftermath of a dog bite or attack.
