What Are Common Causes of Motorcycle Accidents?

Hundreds of thousands of people are injured or killed in motorcycle accidents every year, and it’s a costly problem for the insurance industry and for states that fund health care costs through traffic fines. Motorcycle accidents can be caused by many factors, including driving too fast, wearing a helmet, riding without lights at night, failing to yield right of way, using cell phones while driving on highways, and texting while driving.

When looking at the causes of motorcycle accidents, one can not overlook the fact that motorcyclists have little protection from wind blasts and from cars, trucks, and buses. This usually happens at high speeds and can lead to serious injury or death. It has been a problem associated with motorcycles for years, but with advances in technology, better helmets are available along with better engines and other safety features.

What Are Some Of The Most Common Causes Of Motorcycle Accidents?

1. Head-On Collisions: The most common cause of motorcycle accidents is head-on collisions. Usually, this is caused by one or both drivers who are driving too fast and not paying attention to the traffic conditions around them.

2. Left Turn Accidents: Motorcyclists usually have less room to maneuver than automobile drivers, but they still must follow some of the same driving laws. For instance, even though a motorist may have a “no turn on red” sign posted at an intersection, if the light is green and it’s clear to turn left, the driver must do so just like any other vehicle. However, if the light is red, a motorcycle driver cannot make the turn.

3. Lane Splitting: Lane splitting is legal in some states, including California. However, the driver must only ride between two vehicles at 1 to 10 miles per hour.

4. Speeding and DUI: The most common causes of motorcycle accidents are speeding and drinking and driving.

5. Road Hazards: Motorcyclists commonly have three main ways to avoid collision with road hazards; riding on the safe side of the roadway, riding defensively, or using a bright-colored helmet.

Can I Sue The Other Driver If They Cause My Injuries In A Motorcycle Accident?

If the other driver was the cause of your injuries in a motorcycle accident, you could file a lawsuit against them. In addition to proving that the other driver was at fault, you must also prove that they were acting intentionally or negligently. For example, if another driver is racing a motorcycle and they crash into you, causing you injuries, they would be acting intentionally. On the other hand, if another driver is following too closely and rear-ends you causing an accident, he would be acting negligently.

If you are considering filing a lawsuit against a negligent driver, you should consult with an attorney. They can help you gather the evidence needed for your case and help you determine the amount of money that you should sue for in compensation for your injuries and damages to your personal property.

What Can I Do If I Am Injured In A Motorcycle Accident?

If you have been injured in a motorcycle accident caused by another driver, the first thing you should do is seek immediate medical attention for your injuries. Then, if the accident was caused by another driver, you should get help from an attorney, who can help you recover fair compensation for your pain and suffering. Your attorney will also likely be able to help find a doctor to testify on your behalf during the trial. You should also contact the other driver’s insurance company to find out if they will have a defense.

How Is Liability Determined In A Motorcycle Accident?

If you have been injured in a motorcycle accident that was caused by another driver, the other driver’s insurance company may hire an investigator to determine if they were at fault in the accident. Then, their attorney will contact you and advise you of their findings. After that point, your attorney will likely contact the other driver’s attorney to discuss how much money your client is willing to accept as compensation for their injuries. If your offer is not accepted, you will likely go to trial and present your evidence before a judge or jury. Your attorney will also likely try to negotiate with the other driver for a settlement or offer a generous amount of money.

What Are My Potential Compensatory Damages In A Motorcycle Accident?

You should know that having an attorney represent you in this type of lawsuit is highly recommended. They can help you recover fair compensation for your pain and suffering and damage to your personal property. Your personal injury case may have serious consequences like the loss of income, physical impairment, and other long-lasting damages. You may be entitled to expensive medical bills, physical therapy costs, and possibly loss of future earning potential. If a loved one was killed in the accident, the lawsuit might include the loss of companionship and support. You should contact an injury attorney to help you with your motorcycle accident case as soon as possible after you were injured.

Conclusion:

Motorcycles are a popular mode of transportation, but unfortunately, they are often involved in fatal motorcycle accidents. Motorcycle accidents are often caused by negligent drivers who fail to pay attention to the traffic conditions around them. If you or someone you know has been seriously injured in a motorcycle accident caused by another driver, contact a personal injury attorney as soon as possible. Although it may be difficult to decide on how much compensation you deserve, your personal injury case may have serious consequences like loss of income, physical impairment, and other long-lasting damage.
